Terms of service

By placing an order with Coldsmith ("we", "us"), you ("you", "buyer") agree to these terms. Plain-English version below; we'll keep it short.
1. The service
Coldsmith delivers hand-researched prospect lists with personalized first-liners, in CSV format, via email. List size and delivery timing are described on each pricing tier at the time of order.
2. Your responsibility for outreach
We source from publicly available information. You are responsible for compliance with any laws applicable to your outreach, including but not limited to CAN-SPAM (US), GDPR (EU/UK), CASL (Canada), the Australian Spam Act, and any sector-specific rules (HIPAA, FINRA, etc.). On request, we'll exclude EU/UK prospects from your list.
3. Acceptable use
Coldsmith may decline or refund any order at our discretion, including but not limited to orders for: harassment campaigns, spam-at-scale operations, scams or phishing, prohibited industries (we won't research lists for unlawful goods or services), or anything that would put our payment processor or email sender reputation at risk.
4. Refunds
Our 7-day money-back guarantee is in the refund policy. It supersedes any contrary language elsewhere on the site.
5. Intellectual property
You own the list we deliver to you, for your use. We retain aggregate, anonymized statistics about orders (e.g. distribution of industries, average list size) to improve the service. We don't resell your ICP brief, your contact list, or any custom-research artifact.
6. Payment + currency
All prices in US dollars. Payment is processed by Stripe; we don't store card details. Orders are charged at checkout. We don't currently offer recurring billing.
7. Liability
To the maximum extent permitted by law, Coldsmith's total liability for any claim arising out of an order is limited to the amount you paid for that order. We're not liable for indirect, incidental, or consequential damages (e.g. lost revenue from outreach campaigns).
8. Changes
We may update these terms. Changes apply to new orders placed after the effective date posted at the top of this page. Orders placed before that date are governed by the terms in effect when they were placed.
9. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware.
